Terms of Service
These Terms of Service (the "Terms") govern your use of the website www.recomendas.me and the recomendas.me mobile apps (together, the "Service"). Please read them carefully before using the Service.
1. Introduction
The Service is operated by Marvel Nest, Lda. ("Marvel Nest", "we", "us"), a Portuguese company with tax number (NIPC) 514880066, whose registered office is at Estrada da Portela, 5, Piso 4, Esc. 5, 2790-045 Carnaxide, Portugal.
The agreement between you and Marvel Nest is made up of these Terms and the Privacy Policy, which explains how we collect, protect and use personal data (together, the "Agreement"). By using the Service, you confirm that you have read and understood the Agreement and that you accept it.
If you do not agree with the Agreement, or cannot comply with it, you must not use the Service. In that case, write to us at info@recomendas.me and we will try to find a solution. These Terms apply to everyone who visits or uses the Service.
2. What the Service is
recomendas.me helps people find professionals through recommendations from real people:
- someone who needs help publishes a request and shares the link;
- someone who knows a good professional recommends them, with their contact details and a comment;
- professionals can confirm their contact details to see how many times they have been recommended.
Marvel Nest does not provide the services of the recommended professionals, does not act as an intermediary in hiring them, is not a party to any agreement you make with them and does not receive payments for those services.
3. Personal data and the role of each party
Marvel Nest is the controller of the personal data processed on the Service, within the meaning of Article 4(7) of the General Data Protection Regulation (GDPR). How we do this is described in the Privacy Policy.
When you recommend a professional, you share another person's data. By doing so, you represent and warrant that:
- the professional has authorised you to share their name and contact details for this purpose;
- the data you provide is true and was obtained lawfully;
- the recommendation is based on your own experience or genuine knowledge of the professional.
Anyone who receives professionals' contact details agrees to use them only for the purpose of their request, and never for advertising, resale or building lists.
4. Communications
We only send you the emails or SMS messages needed for the Service to work: access and verification codes, notices about your requests and information about your account.
We only send you promotional communications if you have given your prior and express consent. You can withdraw it at any time, using the link included in each message or by writing to info@recomendas.me.
5. Price and paid features
Using the Service is free. We may in future offer paid features, such as sponsored featured listings for professionals. Before any purchase, we will clearly set out the price, the applicable conditions, the payment method and any right of withdrawal the law gives you. Registering interest in a future feature does not commit you to anything.
6. Minimum age
The Service is intended for people aged 18 or over. By using the Service, you confirm that you are of that age and have the capacity to accept these Terms. If you are under 18, you may not use the Service.
7. Account
To publish a request you need an account, created with Google, with Apple or with a code sent to your email address. You agree to provide true, complete and up to date information.
You are responsible for protecting access to your account, including access to the email account and the device you use to sign in, and for all activity carried out with it. Let us know straight away if you suspect any unauthorised use.
You can delete your account at any time in your account settings. Accounts with no activity for 24 months are deleted automatically, with an email notice 30 days beforehand, as set out in the Privacy Policy.
8. User content
Requests, recommendations, comments and professionals' details ("Content") are published by users, who are solely responsible for their lawfulness, accuracy and appropriateness.
You keep your rights in the Content you publish. So that we can provide the Service, you grant Marvel Nest a free, non-exclusive licence, limited to the time the Content remains on the Service, to store, reproduce and display it to anyone with access to the request, including in the preview of the shared link.
Marvel Nest does not check the accuracy of Content, nor the identity, qualifications, licences, insurance or quality of work of the recommended professionals. Before hiring anyone, check whatever matters to you.
We are not obliged to monitor Content, but we may review, edit or remove it when it breaches these Terms or the law, or when it is reported to us. You can report content in the app itself or by writing to info@recomendas.me.
9. Prohibited uses
You may only use the Service for lawful purposes and in accordance with these Terms. You agree not to use the Service to:
- breach any national or international law or regulation;
- publish recommendations that are false, paid for or given in exchange for something without saying so, or recommend yourself while pretending to be someone else;
- share a professional's data without their permission;
- send spam, advertising, chain letters or any unsolicited commercial communication;
- impersonate Marvel Nest, a Marvel Nest employee, another user or any other person;
- publish content that is offensive, discriminatory, defamatory, threatening, fraudulent or that infringes the rights of others;
- exploit or harm children in any way;
- collect contact details of professionals or users for purposes unrelated to your request.
You also agree not to:
- use robots, scrapers or other automated means to access the Service, publish requests or recommendations, or copy its content;
- get around the limits, checks (including reCAPTCHA) or protections of the Service;
- introduce viruses, malicious code or any technologically harmful material;
- attempt to gain unauthorised access to any part of the Service or to the servers or databases that support it;
- attack the Service with denial of service attacks, whether simple or distributed;
- do anything that prevents, overloads or impairs the normal operation of the Service or its use by other people.
10. Recommended professionals
If you have been recommended, you can confirm your phone number or email address with a code and see how many times you have been recommended. We only show this information once you have confirmed that the contact details are yours.
If you do not want to appear on the Service, or if any content about you is wrong, write to info@recomendas.me. Once we have confirmed your identity, we will erase your data as set out in the Privacy Policy.
11. Intellectual property
The Service and its original content (excluding user Content), including the software, design, text, logos and the recomendas.me brand, are the exclusive property of Marvel Nest or its licensors and are protected by Portuguese and international intellectual property law.
You may not copy, modify, distribute, decompile or reverse engineer the Service, or use our trade marks, without Marvel Nest's prior written permission.
If you believe that content published on the Service infringes your copyright or other intellectual property rights, send us a detailed description of the situation, with the link to the content, at info@recomendas.me, with the subject line "Rights infringement".
12. Suggestions and feedback
We welcome suggestions, ideas, bug reports or complaints about the Service ("Feedback"). By sending them, you acknowledge that Marvel Nest may freely use the Feedback to improve the Service, without any obligation of confidentiality or compensation, and that Feedback should not contain confidential information about you or others.
13. Links to other sites
The Service may contain links to third-party sites or services that Marvel Nest does not own or control, such as the websites of recommended professionals. We are not responsible for their content, privacy policies or practices, and we recommend that you read their terms and policies.
14. Disclaimer of warranties
The Service is provided "as is" and "as available". We do our best to make sure it works without problems, but we do not guarantee that it will always be available, uninterrupted, secure or error free.
We give no warranty, express or implied, about the recommended professionals, the services they provide or the accuracy of the Content published by users.
Nothing in these Terms excludes or limits the guarantees and rights that the law gives you as a consumer and that cannot be excluded by agreement.
15. Limitation of liability
To the fullest extent permitted by law, Marvel Nest is not liable for:
- the services provided by the recommended professionals, or any damage resulting from them;
- agreements, payments or disputes between users and professionals;
- Content published by users;
- indirect damage, loss of profit or loss of opportunity resulting from the use of, or inability to use, the Service.
This limitation does not apply to damage caused by Marvel Nest's wilful misconduct or gross negligence, to death or personal injury, or to any other case in which the law does not allow liability to be limited.
You agree to compensate Marvel Nest for any loss you cause it by breaching these Terms or the rights of others, in particular by sharing a professional's data without their permission.
16. Suspension and termination
We may suspend or delete your account, and remove your Content, if you breach these Terms or the law, or to protect the Service, its users or third parties. Whenever possible and appropriate, we will warn you beforehand and explain why.
You can stop using the Service and delete your account at any time.
On termination, we erase your data as set out in the Privacy Policy. Any provisions of these Terms which by their nature should remain in force after termination will continue to apply, in particular those relating to intellectual property, the disclaimer of warranties, the limitation of liability and the governing law.
17. Changes to the Service
We may change, suspend or discontinue the Service, in whole or in part, in particular for technical or security reasons or as the product evolves. Whenever a change significantly affects the way you use the Service, we will give you reasonable notice.
18. Changes to the Terms
We may change these Terms. The date of the last update is always shown at the top of this page. If the changes are significant, we will let you know on the Service or by email before they take effect.
If you keep using the Service after the changes take effect, we will consider that you accept them. If you do not agree with the new Terms, you must stop using the Service and you may delete your account.
19. Waiver and severability
If Marvel Nest does not exercise a right or does not enforce a provision of these Terms, this does not mean that it waives that right or provision.
If any provision of these Terms is held to be invalid or unenforceable by a court, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in force. These Terms, together with the Privacy Policy, form the entire agreement between you and Marvel Nest regarding the Service.
20. Governing law and dispute resolution
These Terms are governed by Portuguese law, without prejudice to the mandatory consumer protection rules of the country where you live.
In the event of a consumer dispute, you can turn to an alternative consumer dispute resolution body. The list of bodies is available on the Portuguese Consumer Portal (Portal do Consumidor). You can also file a complaint in the Portuguese Electronic Complaints Book (Livro de Reclamações Eletrónico).
